Tribal Representation and Local Land Governance in the Khasi Hills of Meghalaya, India

Abstract

In India, the historically disadvantaged groups of tribal people categorised as the Schedule Tribes have largely remained on the fringes of growth. There is a constitutional provision the Sixth Schedule applicable in certain areas of tribal territorial majorities in the North East of India that recognises the. The question is how effective these legal mechanisms are in protecting the tribal population against marginalisation. This article presents a case study of the socio-political dynamics of community ownership and control of land in the Khasi Hills of Meghalaya, a state in North East India where the tribal people are in the majority. This work aims to analyse more closely the operations and efficacy of the Sixth Schedule as a land governance framework.

Kavita Navlani Soreide is a political scientist with a PhD on Federal Coalition Politics in India. Her current research writings are on the common natural resource management practices and land rights amongst the matrilineal communities in the ecologically sensitive areas of Eastern Himalayas. She is an affiliated researcher with the Centre for Law and Social Transformation, Bergen and Fellow is the Nehru Memorial Museum and Library, New Delhi.

Siri Gloppen is professor of comparative politics at the University of Bergen and Director of the Centre on Law & Social Transformation. Her work focuses on the role of law, courts and legal mobilization in social change. Books include Litigating Health Rights, Can courts bring more justice to Health (Harvard 2011, in Spanish SigloXXI 2013); Courts and Power in Latin America and Africa (Palgrave 2010); Juridification and Social Citizenship (2014).
